At the Outset of European federalism

Abstract

The paper discusses the unification of Europe through the model of federalization, which implies the introduction of the idea of ,,non-dogmatic’’ federalism into the ,,Union’’ and not ,,unity’’ and its establishment, which later became the basis for the legal mechanism of the European Union. In the broader sense of the federal state we call each federal union which takes two different forms: 1) Confederation of States (Staaten Bund) where federation is soft and weak. 2) The federal state (Bundessstaat), where the Federal Union is closer. In 1948 Mikheil Muskhelishvili, along with the French constitutionalist Gaston Stephan, wrote the constitution project of European federalism, important provisions of which became the basis for the future modern law of European Union.
